No, it's not a new fetish I am going to explore, I just thought it sounded cool...

I mentioned in a previous post that I had recently been assaulted, and promised to explain. I’m not going to give you a blow-by-blow, but here it is:

Last week (Wednesday to be exact) I was returning to my studio from a small bit of birthday shopping for my girl, at a nearby thrift store. I had two books, my wallet, and my phone in my hands. I think the reason I was carrying everything was because the shorts I was wearing had zero pockets. I think it was one pocket, which held my keys. Anyways, I came back from the thrift store to find three guys using the loading dock outside my studio windows as a place to skateboard. This cannot be tolerated for various reasons, none of which I am going to take the time to list. One of the three guys had been asked to leave two other times, by yours truly. Each time I’d done my best to remain calm and be polite. Each time it had been a struggle, so when I saw this same person for the third time, I was less polite than usual. Using my phone, I began recording video of them. I stated that they were on private property, and were being politely asked to leave. The first guy I said it to was also holding a video camera, and by the time I was finished speaking he had at least stood up, as if to leave. I pointed my phone at the second guy and repeated my polite plea for him to leave. He put his hand up in front of his face, but I captured enough to identify him if it were necessary.

I then turned to the guy who was standing on the dock, waiting to jump off of it. This was the guy I’d already asked to leave the premises, two times in the past. As I approached the dock with my phone raised, he came toward me, as if he were going to go ahead and jump, despite my request. I have to admit, I did not move out of his way, and he made sure to skate at me and then stop so that his board struck me. Of course, this angered me, and I jumped up onto the dock, cursing at him but still holding onto the phone and recording the action. He took swings at me with the skateboard, some of which connected, and threatened to destroy my phone so I wouldn’t have evidence of it. He pursued me as I backed away, doing my best to defend myself and continue recording. At some point, I had to abandon recording and simply run. By then, all three of the guys were coming after me, and any time I tried to step in for an attack they swung their boards at me. I had nothing but my bare hands, so it was hardly a fair fight. I wound up with bumps, bruises, and abrasions all over my body. It was no fun.

Eventually things wound down and they left. I am sure fear of consequences sunk in, and they decided it was best to stop before they did something they could spend a few years in prison for. Some people I shared this confrontation with asked me why I didn’t fight back. There was one point where I wrestled a board away from one of the guys, and I know I could have used it like they were, or done worse, but it would have meant my life if I had. In Oregon, that sort of thing is called a Measure 11 crime, and comes with a mandatory sentence of 72 months. If I wound up in prison again, at my age, I’d never make it out of that alive. And the worst thing about it is, justified or not, you are likely going to wind up convicted of said crime if you resort to violence to solve an issue/problem. They expect you to do everything humanly possible to avoid that physical confrontation, including running like a bitch, which I had to do at one point. There is no such thing as killing someone in self defense in this state, unless the circumstances are so egregious that you couldn’t help but kill the person attacking you. And I’m smart enough to know that once I take that first swing, I have to follow it up with another, and another, until the person I am hitting clearly has no desire/ability to get up and try to hurt me any more. To hit once, and hope it’s all going to suddenly stop, is just stupid. If I don’t, I’m asking for the ass kicking that comes shortly after.

A few people also asked me why I didn’t call the cops, and that answer could be a post in and of itself. Let’s just say my experiences with the police have left me less than convinced they are the helpful, altruistic individuals they are supposed to be. I once called for assistance, only to have them treat me as if I were the criminal, and have carried that, and my experiences in prison, with me ever since. Add to that the very real reputation Portland police have for being brutal and unreasonable, and maybe you can understand why I don’t trust the police, don’t believe they would help me, and am convinced they probably have better things to be doing with their time. Hopefully this problem will not occur again, but if it does I have the footage to help my case.
